Facts

In the court below the respondent as plaintiff took out a writ of summons in December 1983 claiming from the defendant the sum of N32,500.00 being an outstanding amount under a trading account between the plaintiff company and the defendant company under a Franchise agreement.

When pleadings were ordered the defendant company included a counter-claim for N150,000.00 damages against the plaintiff company in its own Statement of Defence.

After taking evidence on both side with various exhibits tendered by parties, the learned trial Judge delivered judgment in favour of the plaintiff/respondent by awarding him the sum of N32,500.00. The defendant/appellant's counterclaim of N150,000.00 damages was dismissed.
